Joe Biden pledges to make Roe v. Wade ‘law of the land’ if it’s overturned

Democratic presidential nominee Joe Biden pledged to enact legislation making abortion rights the law of the land — should Supreme Court nominee Amy Coney Barrett play a role in overturning a landmark abortion ruling.

Speaking to NBC News at a town hall in Miami, Fla., Monday evening, the former vice president made the claim to moderator Lester Holt after being asked by a woman how he planned to protect reproductive rights with the Supreme Court headed toward a conservative majority.

“Number one, we don’t know exactly what she will do, although expectation is that she may very well move to…overrule Roe,” the Democratic presidential hopeful said at the start of his answer

“And the only thing, the only responsible response to that would be to pass legislation making Roe the law of the land. That’s what I would do,” he continued.

Biden did not offer details to his answer, and the topic wasn’t brought up again when they returned from commercial break.

The GOP-led Senate is plowing ahead with President Trump’s nomination of Judge Barrett. Currently, Republicans hold a 53-47 majority in the Senate, meaning the potential justice could afford to lose three GOP senators and still be the nominee confirmed with Vice President Mike Pence casting a tie-breaking vote.

Barrett’s nomination appears to be heading toward confirmation, which would leave the nation’s highest bench with a 6-3 conservative majority.
