Couple say neighbour’s backyard pizza oven makes their clothes smell

A pizza oven is at the centre of a legal dispute between neighbours.

According to WJW-TV, Brooks Jones and his wife, Mika, of Cleveland Heights, Ohio, are suing their neighbour for the use of a pizza oven in their backyard.

The couple's neighbour, Paul Schambs who lives with Mary Lynne Newsome, allegedly built a commercial size woodfired pizza oven in May 2017 in the backyard of his home.

According to a lawsuit that WJW obtained, Brooks and Mika Jones reside on the second floor of an apartment building that they own two doors away from the pizza oven.

The couple claim that they've been complaining about the item since 2017.

WEWS-TV in Cleveland had reported that during a city council meeting in 2019, Jones made clear his disdain about the pizza oven and the effect it was having on him and his wife.

The City of Cleveland Heights had responded to Jones through a letter that the news publication obtained which included the city confirming the oven did not violate city codes or regulations.

Jones has insisted that the complaints he and his wife have brought up towards Schambs and Cleveland Heights officials have gone unnoticed and ignored.

According to court records, the neighbours were not able to settle the matter.

Citing the lawsuit, it states that when the pizza oven is used, it burns between three and 10 hours long as Brooks and Mika claimed that its usage causes multiple health ailments.

They say the smoke and fumes from the pizza oven cause "coughing, sore throats, headaches, burning eyes, and dizziness."

The couple also claimed that the smell of the fumes gets on their clothes as the pair seek around $25,000 (£20,000) in damages as well as "injunctive relief" in order too prevent Schambs and Newsome from using the pizza oven.
