NYPD investigator in Harvey Weinstein case probed by DA

The Manhattan District Attorney’s office has been thrown a curveball in its Harvey Weinstein sex assault case after learning the NYPD’s lead investigator allegedly failed to disclose witness testimony that challenges an accuser’s account, sources say.

Lucia Evans alleges that the movie mogul forced her to perform oral sex on him inside his Tribeca office in 2004, when she was a young aspiring actress.

But the DA’s office has learned a casting director told Det. Nicholas DiGaudio that Evans told her she performed the sex act to get an acting gig — yet the investigator allegedly failed to share that information with prosecutors, sources say.

The DA’s office met with Weinstein’s attorney Thursday, a police source said

In a statement regarding the incident, the NYPD said only that it “remains fully confident in the overall case it has pursued against Mr. Weinstein.”

“The evidence shows that the criminal case against him is strong. The NYPD will continue to assist the prosecution any way it can to ensure justice is achieved for these brave survivors,” said NYPD spokesman Phil Walzak.

Weinstein has denied the allegations.
