Paz de la Huerta sues Weinstein for potential income loss

“Boardwalk Empire” actress Paz de la Huerta has slapped disgraced movie mogul Harvey Weinstein with a civil suit, claiming she lost millions of dollars in potential income after he raped her twice in Tribeca and exposed himself to her at a hotel in Beverly Hills.

De la Huerta — in revealing the new indecent-exposure claim — says Weinstein invited her to his room at the Four Seasons in January 2011 and greeted her in his bathrobe, according to the lawsuit, which was filed in California Superior Court on Monday.

“Plaintiff alleges that Weinstein opened the door, wearing an opened bathrobe thereby prominently exposing his penis to Plaintiff in a taunting manner,” the suit states.

“Plaintiff also observed another woman undressed in the room and was then invited by Weinstein to participate in a three party sexual encounter,” according to the lawsuit.

De La Huerta, 34, said she had gone to his room intending “to confront him to demand that he leave her alone” after he raped her twice the year before, the court documents say.

In December 2010, de La Huerta, who met Weinstein at age 14 while working on the movie “Cider House Rules,” ran into him at the Boom Boom Room in Manhattan, according to the lawsuit.

Weinstein insisted on giving her a ride home from the club — then pressured her to invite him inside to “discuss business,” the lawsuit states.

“On the way to De La Huerta’s home, Weinstein continuously pressured De La Huerta to have a drink with him. Upon reaching De La Huerta’s home, Weinstein insisted on coming up to De La Huerta’s apartment to avoid discussing business and personal matters in the public lobby of De La Huerta’s apartment building,” the lawsuit says.

“Once inside, Weinstein made warnings to De La Huerta about harm to her career if she did not submit to sex, then forced himself on De La Huerta and raped De La Huerta,” the papers say.

He “left immediately after he raped [her], leaving Plaintiff in a state of absolute shock, humiliation, embarrassment, and pain,” according to the court papers. He later returned and raped her again, she claims.

The lawsuit — which includes photos of the pair at a “Blue Valentine” screening in Soho — alleges de La Huerta suffered “anguish, fright, horror, nervousness, grief, anxiety, worry, shock” due to the rape and indecent exposure, the papers say.

She also claims she lost millions of dollars in potential income , according to the lawsuit, which seeks unspecified damages.

Manhattan prosecutors have declined, at least so far, to pursue criminal charges against Weinstein based on de la Huerta’s claims.

The suit also names Four Seasons Hotels as a defendant.
